Made from talc or talcum powder, baby powder is one of the most commonly purchased items found in the “baby aisle” at the store. It’s a product that’s been used for years, and one whose smell and feel can bring back fond memories for many. Recently, however, talcum powder has been linked to several allegations that its use may cause ovarian cancer.
Talc is a mineral made up of various elements including magnesium, silicon and oxygen. It’s ground up to make a powder which is effective at absorbing excess moisture. It’s a mineral used in many products, from body and facial powders to certain kinds of cosmetic makeup.
In 2013, a civil trial was brought against major manufacturer Johnson & Johnson on behalf of the Plaintiff, Jacqueline Fox. Ms. Fox used both Johnson & Johnson’s Baby Powder as well as their Shower to Shower body powder for over 35 years and had recently been diagnosed with ovarian cancer.
On February 22, 2016, a jury in the City of St. Louis Circuit Court found that Johnson & Johnson’s products did indeed contribute to Ms. Fox’s development of cancer and that they are guilty of negligence, conspiracy, and fraud. They also ruled that the company is liable for the injuries that have been caused by their products, based on their gross negligence in failing to warn their customers.
Analysis of internal company documents revealed that Johnson & Johnson knew about the health risks associated with talc. Not only did they fail to warn their customers who had used the product in the past, but they deliberately made the decision not to change their ingredients and instead kept on selling a product that was known by them to be potentially deadly.
Any women that have been diagnosed with ovarian cancer and that have also regularly used talcum powder for perineal hygiene may be eligible for compensation for their injuries and should contact us for a free case evaluation. Compensation could include payment for medical bills, pain & suffering, and compensation for other damages that may have been caused.
